    Default New Act & Rules for Legal Metrology

    The Legal Metrology Act, 2009 has been passed by the Parliament of India on January 13, 2010. The related rules are

    • The Legal Metrology (Packaged Commodities) Rules, 2011
    • The Legal Metrology (General) Rules, 2011
    • The legal Metrology (National Standards) Rules, 2011
    • The legal Metrology (Numeration) Rules, 2011
    • The Legal Metrology (Approval of Models) Rules, 2011
    • The Indian Institute of Legal Metrology Rules, 2011

    The new Act & Rules will replace the old Standards of Weights and Measures Act, 1976 and Standards of Weights and Measures (Enf) Act, 1985.

    Salient features

    1. The new Act stresses the importance of the usage of standard unit and symbols - like kilogram (kg), carat (c), milligram (mg), litre (l), tonne (t), metre (m) etc.

    2. Manufacturing, selling or importing pre-packaged commodities without mandatory declarations as per rule 6 of LM (PC) Rules, 2011 - Sec 18(1) r/w 36(1) Fine of Rs 25,000 for the first offense. Fine upto Rs 50,000 for 2nd offense and Rs. 50,000 to 1,00,000 for subsequent offense and or 1 year imprisonment.

    3. A manufacturer may repair his own weight or measure in a state where he holds no license.

    4. Appointment of Government approved Test Centers for verification of weights and measures.

    Consumer Protection is the main motto of Legal Metrology Department.

    Default Packaged Commodities Rules 2011

    The Legal Metrology (Packaged Commodities) Rules, 2011

    Packages leaving the manufacturers' premises require all the mandatory declarations.

    Stickers not to be used for making mandatory declarations on a package - rule 6(3).

    Homeopathy, Unani, Sidha, Ayurvedic medicine packages are covered by this rules.

    Allowing the companies to nominate a person who will be held responsible for breach of provisions of the Act, simplified definition of Packaged Commodity and more stringent punishment for violation of provisions.

    Nomination by the director of a firm
    (rule 29 of Legal Metrology (General) Rules, 2011)

    A company may inform the Director or the concerned Controller or his authorized officer, by notice in duplicate, containing the name and address of the Director, who has been nominated by it under sub-section (2) of Section 49 of the Act to be in-charge of and responsible to the company for the conduct of the business of the company or any establishment, branch or unit thereof.

    The nomination will not be valid unless the Director who has been so nominated, gives his consent in writing and has affixed his signature, in duplicate in token of such consent.

    Penalty

    Rule 27 to 31 r/w rule 32(1) : Any one who pre-packs or imports any commodity for sale is required to be registered within 30 days of commencement of pre-packing or importing. Fine of Rs 4000.

    Other rule violation r/w 32(2) : Fine of Rs 2000

    Packer Registration fee Rs 500. Amendment fee Rs 100.

    Sec 7 r/w 25 : Using or keeping for use of any w/m not in standard unit : Rs 25,000/6 months
    Sec 8 r/w 27 : Manufacturing or selling non-standard w/m : Rs. 20,000/ 3 years.
    Sec 10 r/w 28 : Transaction by not using prescribed w/m as specified in Sch I (Specific Commodities has to be packed in weight/volume/number) : Rs.10,000/ 1 year.
    Sec 11 r/w 29 : Making expression, quotation, advertisement or document in non-standard units : Rs 10,000 / 1 year.
    Sec 15 r/w 40 : Obstructing Officers of Legal Metrology from discharging official duties : 2 years/ 5 years (2nd offence)
    Sec 17 r/w 31 : non production of any w/m, records, registers by M/D/R etc : up to 5,000/ 1 year.

    Section 18 (1) r/w 36(1) : It shall be illegal to manufacture, pack, sell, import, distribute, deliver, offer, expose or possess for sale any pre-packaged commodity unless the package is in such standard quantities or number and bears thereon such declarations and particulars in such manner as may be prescribed : Fine of Rs 25000/up to 50000/50000 to 1 lakh or 1 year imprisonment or both.
    Sec 18 (1) r/w 36(2) : Manufacturing, selling or importing pre-packaged commodities with error in net quantity beyond prescribed limit : Rs 10,000 to 50,000/1,00,000 or 1 year imprisonment or both.

    Sec 23(1) r/w 45 : Manufacturing w/m without valid licence : Rs 20,000/1 year
    Sec 23(1) r/w 46 : Selling or repairing w/m without valid licence : up to Rs 5,000/1 year.

    Sec 26 : Tampering of any w/m for deceiving : Rs 50,000/ 6-12 months
    Sec 30 : Receiving less quantity in a contract/sale : up to Rs 10,000.
    Sec 37(1) : Contravention by Test Centres : Rs.1,00,000
    Sec 37(2) : Willful verification or stamping w/m in contravention of the Act by owner or employee of Test Centres : 1 year.
    Sec 47 : Tampering of license : Rs. 5,000 to 20,000 /1 year

    Rule 6 : Pre-packed Commodity for sale, distribution or delivery must bear thereon or on a label securely affixed thereto, the following declarations -

    * the name and address of the manufacturer, or where the manufacturer is not the packer, the name and address of the manufacturer and packer and for any imported package the name and address of the importer.

    * The name, address, telephone number, e mail address, if available, of the person who can be or the office which can be, contacted, in case of consumer complaints.

    * the common or generic names of the commodity contained in the package and in case of packages with more than one product, the name and number or quantity of each product.

    * the net quantity, in terms of the standard unit of weight or measure, of the commodity contained in the package or where the commodity is packed or sold by number, the number of the commodity contained in the package;

    * the month and year in which the commodity is manufactured or pre-packed or imported.

    * the retail sale price of the package

    * where the sizes of the commodity contained in the package are relevant, the dimensions of the commodity contained in the package and if the dimensions of the different pieces are different ,the dimensions of each such different piece.

    Rule 6(3)
    : It shall not be permissible to affix individual stickers.

    Rule 18(1)
    : No wholesale dealer or retail dealer or importer shall sell, distribute, deliver, display or store for sale any commodity in the packaged form unless the package complies with, in all respects, the provisions of the Act and these rules.

    Default Facilities/Services

    • Weigh Bridge : They are of Pit type and pit less type with capacity varying from 10 to 200 ton.

    Load Cell is the heart of an electronic weigh bridge. A load cell is a transducer that is used to convert a force into electrical signal. It senses the strain and convert it to mV and the micro controller based Digitizer converts the signal received to weight. Display is of LED/LCD 7 segment type reading weight in kg/t. Using an RS 232C port, the data can be send to a computer for taking printout. Password protected software is used for calibration of the Weighbridge.





    The Weigh Bridge verification Mobile Kits are efficiently utilized by the Legal Metrology Department for testing the accuracy of Weigh Bridges in the Kerala State. Each kit is provided with verified test weight of the range of 1 ton to 50 kg with a maximum of 12100 kg. A folding type hydraulically operated crane is mounted on the test kit to lift these weights. The time duration for this verification has been reduced by 3 to 4 hours. The main advantage of this kit is that the verification is quick and highly accurate. A user fee of Rs 5000/- per unit has been fixed by the Government for utilizing this facility.

    Default Gold Hallmarking

    • Hallmarking

    Pure gold (Au) is soft and very malleable. It has a melting point of 1064 deg. C. As gold is too soft, jewelers mix copper, silver, palladium to make gold ornaments. Purity of gold is measured in Carat (ct). So basically, a gold ornament is an alloy. The word carat is etived from the Greek word kerátion. The spelling karat (k or kt) is used in US and Canada

    It is said that more than 40% of gold (969 t of gold/annum - World Gold Council report 2011) in the world is purchased by Indians. Hallmarking system in gold ornaments was introduced in the country by the year 2000, under the certification scheme of BIS (Bureau of Indian Standards). For this, recognition is given to Hall Marking and assaying centers for hallmarking of gold jewellery as per relevant Indian Standards (IS 141).

    Goldsmith's company was headquartered in London at Goldsmiths' Hall from whence the English term "hallmark" is derived. In 1478, Assay office was at Goldsmiths' Hall.

    Hallmark is the symbol, which indicates your gold jewelry is genuine gold. Pure gold (100 %) is made of 24 karat and is practically impossible. Electrolytic refining can produce 999 gold. The number associated with Gold Hallmark varies with gold purity. A 9 carat gold item will have 375 in it. A 14 carat item will have 585 on it. On an 18 carat item, 750 will be put. 916 can be seen on 22 carat gold (91.6% gold). 80% of the gold jewellery is of 22 ct.

    Hallmark is done using punches or by Laser marking machines. Hallmarking is done on gold, silver and platinum.

    Jewelers own Hallmarking centres (working on the guidelines of BIS) and are putting the mark of their own gold ornaments. In Kerala, public can know the purity of their gold ornaments from Gold Purity Testing Laboratory at Kakkanad Legal Metrology Bhavan, Kochi (Phone-0484-2423180) and it avoid cheating in terms of purity of gold.

    Gold Purity Tests

    Earlier Acid test kits were used to find the purity of the gold (Fire Assay Method/ Cupellation). A small sample is taken randomly and is lost during the test. The test result tells only about the purity of the outer layer of gold in the ornament. Now Electronic testing kits, X-ray fluorescence (a non-destructive technique) etc. are widely used to find gold purity.
