    Default Sec 24 r/w 33 of the Legal Metrology Act, 2009

    Sec 24 : Every person having any weight or measure in his possession, custody or control in circumstances indicating that such weight or measure is being, or is intended or is likely to be, used by him in any transaction or for protection, shall, before putting such weight or measure into such use, have such weight or measure verified at such place and during such hours as the Controller may, by general or special order, specify in this behalf, on payment of such fees as may be prescribed.

    Sec 33
    : Whoever, sells, distributes, delivers or otherwise transfers or uses any unverified weight or measure shall be punished with fine which shall not be less than two thousand rupees but which may extend to ten thousand rupees and, for the second or subsequent offence, with imprisonment for a term which may extend to one year and also with fine.

    Sec 2(k) :
    "protection" means the utilisation of reading obtained from any weight or measure, for the purpose of determining any step which is required to be taken to safeguard the well-being of any human being or animal, or to protect any commodity, vegetation or thing, whether individually or collectively;

    Sec 2(u) : "transaction" means,- (i) any contract, whether for sale, purchase, exchange or any other purpose, or (ii) any assessment of royalty, toll, duty or other dues, or (iii) the assessment of any work done, wages due or services rendered;

    So in my opinion, it is better to get it verified and stamped annually. In the worst case, if a case is booked, it will be difficult to prove your side.

    Default Check weights to be maintained

    The users of weighing instruments of capacity 1 tonne and above has to keep one tenth of the capacity or 1 tonne, which ever is less of verified and stamped weights to check the accuracy of the instrument.

    So weigh bridges have to keep 1 tonne stamped weights in the trade premises to check the accuracy of the instrument.

    Default Waiting for Amendment of KLM Enf rules

    The Kerala Legal Metrology (Enforcement) Rules, 2012 is going to be get amended soon.

    Salient points in the amendment expected :

    1.
    Stamping fee, insitu fee and licence fee has to be revised/increase in the fee rates.
    2. All auto rickshaw/motor cab having Taxi permit has to maintain a duly stamped Taximeter.
    3. Auto rickshaws//motor cabs charging excess fare will be fined
    4. Additional fee :minimum Rs 100 or half the stamping fee to a maximum of 24 quaters
    5. Compounding fee for various offences has to be revised

    5/10/20 kg - Rs. 30

    2. Bullion weights

    1/2/5 kg - Rs. 30
    1 to 500 g - Rs. 23

    3. Capacity measures

    10/20 l - Rs. 30
    Peg measure (30/60/100 ml) - Rs. 75

    4. Length measures

    0.5 m - Rs. 30
    Survey chain of 20/30 m - Rs. 150

    1. Beam scales - 50% increase, except '500 g and below C&D' at Rs. 10.

    2. Counter machine : 1 kg & below - Rs. 20, Above 1 kg and below 10 kg - Rs. 30

    3. NAWI Mech Class III & IV

    2 t & below : 50% increase

    2 t - Rs. 600
    1.5/1/0.5 t - Rs. 450
    250/300 kg - Rs. 300
    30 to 200 kg - Rs. 150
    20/25 kg - Rs. 90

    4. NAWI Electronic Class III & IV

    5 t and below : 50% increase

    5. NAWI Class I & II

    10 t and below : 50% increase

    6. Autorickshaw Taxi meter - Rs. 150

    7. Dispensing pump Rs. 1500, Totaliser - Rs. 750

    Default Miscellaneous fee hike

    Packer Registration fee - Rs. 750
    Packer Registration Amendment fee - Rs. 150
    Compounding fee for non registration as Packer/Importer (rule 32) - Rs. 5000

    Security deposit by Repair licencee - Rs. 6250
